I recently flew from LGW to Turin, the flight was said to be cancelled due to operational reasons. I was rerouted through AMS with a total of 6 hrs of delay. I filed a claim under EU 261 and it was rejected. I want to jnow what I can do further. I append the gist of the rejection received below. Are they trying to fob me off or are they right in claiming extraordinary circumstances ?
Your claim for compensation has been refused because flight BAxxx on
3 October 2014 was cancelled due to aircraft damage which was not caused by British Airways, which prevented the aircraft operating as scheduled. Under EU legislation, British Airways is not liable for a compensation payment in this situation.
During final safety checks, we discovered a problem with the emergency light lens cover. There are numerous parts that the airline may be required to replace within a specific timeframe. These parts are kept fully stocked and ready to fit. As this particular part was not due to be replaced, this constitutes as extraordinary circumstances.
All help is appreciated!
